Biogen Acquisition of Apellis Spells End to Derivative Lawsuit

Apellis Pharmaceuticals Inc. shareholders who sued the drugmaker’s leadership for allegedly concealing the safety risks of a blindness-prevention drug are dropping their suit following Biogen Inc.'s $5.6 billion acquisition of the company.

After the deal’s completion May 14, the investors no longer hold Apellis stock and therefore lack standing to sue on its behalf, they told the US District Court for the District of Massachusetts on May 29. The voluntary dismissal order was entered the same day, signed by Judge Julia E. Kobick.
