Humana Arguments in Medicare Payment Case ‘Meritless,’ DOJ Says

The Department of Justice asked a federal judge in Texas on Thursday to disregard arguments made by Humana Inc. and grant summary judgment for the government in the insurer’s lawsuit over HHS efforts to claw back billions of dollars in alleged overpayments to private Medicare managed care plans.

The cross-motion for summary judgment filed with Judge Reed O’Connor of the US District Court for the Northern District of Texas is in response to Humana’s summary judgment motion filed in October.
