Perrigo Co. and Ranir LLC failed to defeat parents’ claims that their mouthwashes, which are designed to appeal to kids, don’t clearly alert consumers that ingesting a key ingredient, fluoride, can harm young children, a federal court ruled Thursday.
Judge Lindsay C. Jenkins, with the US District Court for the Northern District of Illinois, denied the companies’ motion to dismiss a failure-to-warn complaint brought by parents.
