Becton Dickinson & Co. and C.R. Bard Inc. largely lost their bid for summary judgment in a bellwether plaintiff’s suit alleging the companies’ implanted port catheters were defective and led to medical complications.
The US District Court for the District of Arizona on Thursday denied the companies’ motion in all respects except plaintiff Robert Cook’s misrepresentation claim. Cook is one of thousands of people who alleged Bard IPC devices designed, manufactured, and marketed by the defendants caused a port-related infection; his is one of several bellwether cases headed to trial later this year.
