Apple, Masimo Clash on Speed and Scope of Watch-Ban Fight

Apple Inc. urged the US International Trade Commission to defer to the Federal Circuit on the question of whether redesigned Apple Watches violate an existing import ban, Masimo Corp. told a federal judge.

Masimo filed the notice Thursday in its lawsuit against US Customs and Border Protection in the US District Court for the District of Columbia. It told Judge Ana C. Reyes that Apple’s Sept. 15 ITC response pressed the commission to defer ruling on Masimo’s petition.
