NLRB Judge Rules Against Hospital That Challenged Agency’s Structure

A Massachusetts hospital that unsuccessfully sued to stop the National Labor Relations Board from moving forward on an unfair labor practice case lost before an agency judge.

NLRB Administrative Law Judge Susannah Merritt ruled in a Friday opinion that VHS Acquisition Subsidiary Number 7 Inc., which does business as the Saint Vincent Hospital in Massachusetts, committed numerous labor law violations.

Attorneys for the NLRB’s general counsel alleged the company illegally withheld bonus payments from employees under negotiated shift incentive contracts, and subsequently blamed the union for the lack of payment.
