SpaceX’s flight launches may pose safety risks sufficient to occasionally ban access to a nearby public beach, some justices on the Texas Supreme Court said during oral arguments Thursday, signaling that the Elon Musk company can likely continue to use the area.
The justices indicated that the government maintains authority to keep people off beaches for safety reasons just as it would in a storm or an oil spill, even though in this case SpaceX is creating the danger.
