EPA Drops Biden-era Plan to Allow PFAS Cleanups Under Waste Law

The EPA withdrew Friday a Biden-era proposed rule to clarify that significantly harmful materials could be managed under one of the major hazardous waste control laws.

The proposed rule would have defined hazardous wastes under the Resource Conservation and Recovery Act as being able to “cause, or significantly contribute to an increase in mortality or an increase in serious irreversible, or incapacitating reversible, illness.”

That would have clarified that the Environmental Protection Agency and states could require cleanups of PFAS or other substances that could cause significant harm, even if the pollutants aren’t listed specifically as hazardous wastes under RCRA ...
