MasTec Unit at Fault for Boom Operator’s Death, 11th Cir. Says

A MasTec Inc. subsidiary remains on the hook for a nearly $13,000 fine stemming from the death of a truck-mounted boom operator after the Eleventh Circuit backed a federal safety citation against the company.

The federal government sufficiently established the elements of a serious general duty clause violation, according to the US Court of Appeals for the Eleventh Circuit.

The Occupational Safety and Health Review Commission decision was supported by substantial evidence that the company didn’t maintain a workplace free of hazard, said Judge Robert J. Luck, an appointee of President Donald Trump, in upholding the citation.
