The US Department of Education and a prominent teachers union have agreed to settle the union’s suit that claimed a DOE letter to colleges and schools that threatened funding for their DEI programs is unconstitutional.
The “dear colleague” letter sent in February of 2025 and other “challenged Agency Actions” were allegedly unconstitutional and “contrary to law, arbitrary and capricious,” and “in excess of statutory authority,” according to a recap of the allegations contained in the joint motion to dismiss the suit filed Tuesday to the US District Court for the District of New Hampshire.
