The Supreme Court agreed to weigh in on a Trump administration challenge to a lower court decision vacating a deportation order against a Chinese national who claimed the US mishandled his immigration status.
The grant on Friday follows a decision by the US Court of Appeals for the Second Circuit, which reversed an immigration law judge’s decision to deport Muk Choi Lau following his conviction on trademark counterfeiting charges in 2013.
The issue involves whether the Homeland Security Department correctly classified Lau, who was a lawful permanent resident, when he reentered the country from a trip to China while his case in New Jersey state court was pending, and how that designation ultimately affected the removal proceedings.
