A transgender nurse lacked sufficient evidence to succeed on claims that she endured a hostile workplace before, during, and after her transition, only to be fired by her employer, a federal court said.
Even assuming Emily Barry stated a sex discrimination claim under Title VII, she didn’t overcome Jefferson Community Hospitals Inc.'s assertion that it had a legitimate reason for firing her, the US District Court for the Eastern District of Pennsylvania said Tuesday. The employer introduced several reports of unsatisfactory care affecting patient safety she provided in the weeks prior to her termination, Judge Gerald A. McHugh said.
