CVS, Omnicare Unable to Knock Out $949 Million Fraud Ruling (1)

CVS Health Inc. and subsidiary Omnicare Inc. failed to convince a New York federal court to overturn a $949 million judgment against them in a prescription drug fraud suit.

A jury saw sufficient evidence in the False Claims Act trial to conclude that Omnicare allowed pharmacies to dispense drugs on invalid prescriptions, and CVS failed to rebut the jury’s conclusion that the pharmacy services company caused the submission of false claims to the government, Judge Colleen McMahon said in a Monday order.
