Texas App Store Injunction Remains Blocked, Fifth Circuit Says

Texas will likely prevail in defending a law requiring proof of age to download a smart phone app, a federal appeals court ruled Thursday, lifting a trial court injunction that halted the law on First Amendment grounds.

The law will remain in effect throughout the state’s appeal, which the US Court of Appeals for the Fifth Circuit indicated it’s likely to win.

“The balance of equities and public interest are clearcut in Texas’s favor,” the judges said in an unsigned order.
