HPE Can’t Escape Wireless Communication Tech Patent Suit (2)

Hewlett Packard Enterprise Co. failed to convince a Texas federal judge to throw out Stingray IP Solutions LLC’s lawsuit accusing it of infringing wireless communication protocol patents.

HPE didn’t show how a magistrate judge’s report and recommendation to deny a motion to dismiss was erroneous, according to an order filed Wednesday in the US District Court for the Eastern District of Texas. Judge Rodney Gilstrap adopted the recommendation, stating HPE’s objection was unpersuasive in claiming Stingray IP didn’t allege how it practiced any of the protected methods.
