Pinterest Inc. failed to nullify a trio of targeted-ad and playlist curation patents that a US subsidiary of Switzerland-based Kudelski SA accused it of infringing in Delaware federal court.
While targeted advertising is an abstract concept, OpenTV Inc. plausibly alleged its patent added an inventive concept to advance it, the US District Court for the District of Delaware said. A legitimate dispute over the interpretation of claims in the two smart playlist patents means that litigating the meaning of “social connections” in the patents “would be beneficial before deciding” their validity, the court added.
