Audible Inc. convinced a Washington state federal court to dismiss the California claims of a proposed class action over the Amazon unit’s use of Meta Platforms’ tracking pixel.
The plaintiffs were sufficiently aware that Washington law—rather than California law—would govern their dispute, the US District Court for the Western District of Washington said. Judge Kymberly K. Evanson said that their complaint, which exclusively relied on California law, failed to state a claim the Washington court could address. The plaintiffs have one month to amend the complaint.
