The Fourth Circuit denied the Justice Department’s effort to dismiss its court fight against Maryland’s federal district judges.
The brief order issued Tuesday said the case is “not moot,” citing a previous Fourth Circuit ruling and a Supreme Court decision. The court told the Justice Department to file its opening brief by March 23.
The Trump Justice Department last month sought to dismiss the case, which challenged standing orders that temporarily blocked the immediate deportation of any detained non-citizen who filed a habeas petition at the court.
