The full US Court of Appeals for the Fifth Circuit will review a lawsuit from Jackson, Miss. residents that alleged wrongdoing by city officials over tainted drinking water.
A divided three-judge panel in November revived a claim against the city that residents’ right to bodily autonomy was violated, and instructed the trial court to weigh if Jackson itself could also face a separate allegation that residents suffered from a “state-created danger.”
