Northwell Health Plan ERISA Suit Gets Recommended for Dismissal

A proposed class action challenging disclosures related to a 1999 conversion of North Shore University Hospital’s traditional benefit plan to a cash balance plan should be dismissed, a magistrate judge said.

Disclosures of changes to the Northwell Health Pension Plan leading up to and following the conversion provided participants sufficient notice under the Employee Retirement Income Security Act, Magistrate Judge Anne Y. Shields of the US District Court for the Eastern District of New York said Wednesday in a nonbinding recommendation.
