Blue Cross Wins Class Decertification in Claim-Deadline Case

An Illinois appellate court reversed a grant of class certification Friday in a case claiming Blue Cross Blue Shield of Illinois didn’t decide claims within its deadline or provide proper explanations of benefits.

The effort to certify a class “forced a square peg into a round hole,” Justice Celia Gamrath of the First District of the Illinois Appellate Court wrote. Thousands of claims were potentially covered by the certification.
